TERMS and Conditions

SilverFox – Terms and Conditions of Sale

1. Scope

These Terms and Conditions apply to all purchases made in the SilverFox online store at www.silverfoxcontrollers.com and to orders placed directly with SilverFox by email, by consumers and businesses in Finland and abroad.

Where a provision applies only to consumers or only to business customers, this is stated. A consumer is a natural person buying mainly for purposes outside their trade or profession. A business customer is anyone buying for business purposes, including resellers.

These terms do not limit any mandatory rights a consumer has under the laws of Finland or of their country of residence.

Products bought from an authorised SilverFox reseller are sold under that reseller's own terms. Warranty and return matters for those purchases are handled through the reseller.

2. Seller

Company: Pietilä Subcon Oy / SilverFox Controllers

Business ID: 2198922-5

EU VAT ID: FI21989225

Address: Ahonpääntie 181, 03850 Lohja, Finland

Email: info@silverfoxcontrollers.com

3. Orders and contract formation

Product pages, prices and pictures on the website are an invitation to make an offer. By completing checkout, the customer places a binding order. The contract is formed when SilverFox sends an order confirmation by email. SilverFox may decline or cancel an order, for example if a product is out of stock, a price is clearly wrong, or delivery to the destination is not possible. Any payment already made is then refunded in full. The customer must check the order confirmation and report any errors to SilverFox without delay.

Custom-made or modified products (non-standard mechanics, cabling, connectors or firmware made to the customer's specification) are agreed separately by email. The written offer and these terms apply together.

4. Prices and VAT

Prices are in euros (EUR). Shipping costs are shown at checkout before the order is placed.

  • Consumers in the EU: prices include VAT. VAT is charged at the rate applicable under EU VAT rules for the delivery country.

  • Business customers in the EU outside Finland: when a valid EU VAT ID is given at checkout and verified, the sale is VAT-free under the reverse-charge mechanism, and the buyer accounts for VAT in their own country.

  • Business customers in Finland: Finnish VAT is added.

  • Customers outside the EU: the sale is an export without Finnish VAT. Import VAT, customs duties and clearance fees in the destination country are not included in the price (see section 7).

SilverFox may change prices at any time. The price valid at the time of the order applies.

5. Payment

Payment is made at checkout with the payment methods shown there. Payments are processed by third-party payment providers; SilverFox does not store card details. Orders are shipped once payment has been received. Business customers with an agreed account may be invoiced; the payment term is stated on the invoice. Late payment interest is charged under the Finnish Interest Act.

Ownership of the goods passes to the customer when the purchase price has been paid in full.

6. Shipping and delivery

SilverFox ships worldwide, except to destinations restricted by sanctions or export controls. Available shipping methods, costs and estimated delivery times are shown at checkout. Products in stock are normally dispatched within a few working days of payment. Custom-made products are delivered on the schedule agreed in the offer. If a delivery is delayed, SilverFox will inform the customer and give a new estimated date. A consumer may cancel the order if the delay is significant.

Risk of loss or damage passes:

  • to a consumer when they, or a person they name, receive the goods;

  • to a business customer under DAP (Incoterms 2020) at the named delivery address, unless otherwise agreed in writing.

The customer should inspect the parcel on receipt. Visible transport damage should be noted with the carrier and reported to SilverFox within 7 days, with photos. If a parcel is returned to SilverFox because it could not be delivered or was not collected, SilverFox may deduct the actual return shipping cost from any refund.

7. Customs, duties and export

For deliveries outside the EU, the customer is the importer. Import VAT, customs duties, brokerage and clearance fees in the destination country are paid by the customer and are not refunded by SilverFox. These charges may be collected by the carrier on delivery. If the customer refuses to pay these charges and the parcel is returned, section 6 on returned parcels applies. SilverFox products contain Bluetooth radio equipment. The customer is responsible for checking that the products may be imported and used in the destination country. SilverFox prepares the export documents (commercial invoice) for each shipment.

8. Right of withdrawal (consumers)

Consumers have the right to withdraw from an online purchase within 14 days without giving a reason. The period starts on the day the consumer receives the goods; for an order delivered in several parts, on the day the last part is received. SilverFox offers this right to consumers in all countries.

How to withdraw. Before the 14 days end, notify SilverFox in one of these ways:

  • the online withdrawal function on our website, “Withdraw from contract here”;

  • an email to info@silverfoxcontrollers.com with your name, order number and the products returned;

  • the model withdrawal form in the Annex.

We confirm receipt of the withdrawal by email without delay.

Returning the goods. Send the goods back without undue delay and no later than 14 days after notifying us, to the address in section 2. The consumer pays the direct cost of returning the goods. Returns from outside the EU must be sent so that SilverFox is not charged any import duties or fees. Refund. Within 14 days of the withdrawal notice, we refund the price of the returned goods to the original payment method. Return costs are not refunded. Original delivery costs are refunded only to EU/EEA consumers, up to our cheapest standard delivery option. We may withhold the refund until we receive the goods or proof of return. Condition of the goods. The consumer may examine the product as they would in a shop. The consumer is liable for any reduction in value caused by handling beyond that, for example installation on a vehicle, cutting or shortening cables, opening the housing, or visible wear. Exceptions. The right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised (section 3).

9. Defects, statutory rights and warranty

Statutory rights (consumers). Products must conform to the contract. If a product is defective, consumers have the remedies provided by the Finnish Consumer Protection Act and the mandatory law of their country of residence: repair, replacement, price reduction or cancellation. SilverFox's liability for defects present at delivery lasts at least two years. The consumer should report a defect within a reasonable time after discovering it. SilverFox warranty. In addition to these statutory rights, SilverFox gives a one-year warranty on parts and manufacturing from the date of delivery. The warranty does not limit a consumer's statutory rights. It does not cover:

  • damage from accidents, crashes, falls or incorrect installation;

  • modifications, opening of the housing, or repairs not approved by SilverFox;

  • use outside the specifications (e.g. supply voltage outside 5–24 V DC, immersion beyond the stated IP rating);

  • installing firmware other than official SilverFox firmware for that model;

  • normal wear, such as surface wear and cable wear from handlebar movement.

How to make a claim. Contact info@silverfoxcontrollers.com with the order number, the product's serial number, a description of the fault and, if possible, photos or video. Do not send the product before SilverFox has confirmed the claim and given return instructions.

10. Business customers: inspection and claims

Business customers must inspect the goods on receipt and report any defects or shortages in writing within 14 days of delivery. Hidden defects must be reported within 14 days of discovery and no later than 12 months after delivery.

For accepted claims, SilverFox will repair or replace the product, or refund the price, at its discretion. These are the business customer's only remedies for defects. There is no right of withdrawal for business customers; returns of non-defective goods are accepted only by separate agreement.

11. Limitation of liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for intentional acts or gross negligence, under product liability law, or any other liability that cannot be limited by law. Consumers' mandatory rights are not affected.

For business customers, SilverFox is not liable for indirect or consequential loss, such as loss of profit, loss of use, lost data or third-party claims. SilverFox's total liability to a business customer is limited to the price paid for the product concerned.

12. Safe use

SilverFox controllers are accessories for operating navigation apps and devices. They do not replace the rider's attention to traffic and are not safety equipment.

  • Install the controller so that it does not interfere with the vehicle's controls, switches or steering.

  • Change settings, pair devices and calibrate only when the vehicle is safely parked.

  • Follow the installation instructions on our website and the traffic laws of the country where the vehicle is used.

SilverFox is not responsible for the operation, accuracy or availability of third-party navigation apps, phones or tablets. App compatibility lists reflect our own testing and may change when those apps are updated.

13. Firmware and the InControl app

The firmware in SilverFox products is licensed, not sold, for use with the SilverFox product it ships with. It may not be copied, reverse engineered or modified except as permitted by mandatory law. SilverFox may offer firmware updates via Wi-Fi or Bluetooth. Updates are optional. Install only official firmware intended for your product model and follow the published instructions. Damage caused by installing the wrong file, interrupting an update, or using unofficial firmware is not covered by the warranty. The SilverFox InControl app is offered free of charge through Google Play, subject to Google Play's terms and the app's own privacy information. The app is not required for the basic use of SilverFox controllers.

14. Personal data

SilverFox processes customers' personal data to handle orders, deliveries, payments, warranty claims and customer service, and to meet accounting obligations. Data is shared only with the service providers needed for these purposes, such as the web store platform, payment providers and carriers. More information is in our Privacy Policy.

15. Force majeure

SilverFox is not liable for delays or failures caused by events beyond its reasonable control, such as natural disasters, war, sanctions, strikes, pandemics, carrier disruptions or component shortages. SilverFox will inform the customer without delay. If the event lasts more than two months, either party may cancel the affected order, and payments for undelivered goods are refunded.

16. Governing law and disputes

These terms and all purchases are governed by the laws of Finland. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply. Consumers. The choice of Finnish law does not deprive a consumer of the protection given by the mandatory provisions of the law of their country of residence. Please contact us first at info@silverfoxcontrollers.com; we aim to resolve every complaint quickly. Consumers resident in Finland may bring a dispute to the Finnish Consumer Disputes Board (Kuluttajariitalautakunta, www.kuluttajariita.fi) after first contacting the Consumer Advisory Services. Consumers in other EU/EEA countries can get free help from the European Consumer Centre in their country (ECC-Net). A consumer may also bring a claim in the courts of their place of residence.

Business customers. Disputes are settled by the Länsi-Uusimaa District Court in Finland. SilverFox may also bring a claim in the courts of the business customer's domicile.

17. Language and changes

These terms are written in English. If they are translated, the English version prevails, except where a consumer's mandatory law requires otherwise. SilverFox may update these terms. The version published on the website at the time of the order applies to that order.
